Excerpt from "Radd ur'Rafadhah" by Ala Hazrat
    ------------------------------------------------------------------

It is stated in Durre Mukhtaar

If someone denies any of the necessities of the religion, he is a disbeliever; for instance, to say that Almighty Allah possesses a body like the physical bodies, or to refuse the Companionship of Hazrat Abu Bakr Siddeeq.

and Tabarra is a mixture of many of the above: this includes lying, back-biting, slander, using filthy language, denying of hadeeth etc - so is definitely one of the most abominable and Haraam acts..................

and if these things are done with the belief that they are "halaal" it is outright Kufr.

and those who do Tabarraee, most of them vehemently believe it to be "Halaal" although it is a mixture of so many Haraam acts; so even according to the Mutakallemeen, it would constitute blatant Kufr.

Is there any Tabarraee who Considers Tabarra haraam?
    -----------------------------------

The Jurists and the theologians do not differ on the issue that one who (1) Rejects the Companionship of Syedna Abu Bakr (radiAllaho anho), or (2) Slanders Syedah Aayeshah Siddeeqah (radiAllahu anhaa) - is a disbeliever; for he is rejecting the clear proof from the Holy Qur'an.

Is there any Tabarraee who accepts the Companionship of Syedna Abu Bakr?
    ----------------------------------

and guidance is from Allah, the Supreme, the Most Truthful.

among other things that does not make one a kafir:

    - adultery
    - drinking wine
    - gambling
    - murder
    - stealing
    - using filthy and profane language
    - lying
    - killing one's own parents
    - beating one's own parents
    - homosexuality
    - etc. etc.

add rest of the outrageous unmentionable acts that do not make one a kafir.

that does not mean one should indulge in them, or encourage people to indulge in those actions or if a person commits murder tell him: "don't worry, it won't make you a kafir".

    nas'alu Allaha al-aafiyah.

There may be other reasons but alahazrat mawlana ahmed raza khan says that 'my opinion' and that of ulama of aqida is that rejection of khilafat of shaykhayn and tabarra do not take one out of the fold of Islam. That was the point. according to him rejection of khilafat of hz abu bakr and hz umar does not make you a kafir.

as usual - pick an choose. from the entire text, just a few words.............

Ala Hazrat has already cited so many decrees of the fuqaha - that the Tabaraaee ARE disbelievers. Show us where has he refuted those decrees? He however mentions the "cautious position" of the theologians and says it is the adopted way. and what do the theologians call them? "heretics" and "dogs of hell". it does NOT rule out the possibility of them being actually disbelievers, because it is a "cautious approach".
    -----------------------------
and in the very next para he says"However the modern day Raafidhis are not only Tabarra’ee (abusive / cursers), but they publicly, openly deny the fundamentals of religion. And so, most certainly, by the consensus of Muslims scholars, they are surely disbelievers and apostates."

you could have chosen this sentence.

Alahazrat says that those who reject the Khilafat of shaykhayn and do tabarra are misguided and jahannami but are NOT kafirs.

It is applicable; provided they come to know of the Kufriyyat, and still deem the writer of the Kufriyyat as a Muslim.

This is what Ala Hazrat says even about Jaahil Rafidhis
"And supposedly, if a Raafidhi refuses to accept verdicts of his authoritative scholars, he will – at the very least – refuse to consider them disbelievers because of these disbeliefs."

So the verdict is upon those who come to know the disbeliefs, accept them as "correct" or refuse to label the holder of such disbeliefs as an apostate.

Ala Hazrat Imam Ahmed Raza Khan's answer to a question posed to him regarding the Shia who curse the companions and also deny the fundamentals of faith; to a specific question, Ala Hazrat gives a detailed answer including the reasons for it and additionally explains why the Tabbaraaee Rafidhi Shia's are apostates.

The detailed answer (short by his standards), is a must read for all.

    THE QUESTION

What do the Muslim scholars say regarding this matter: A Sayyed Sunni lady has passed away, and some of her cousins are Raafidhi Tabarra’ee Shias (those who curse the noble Companions). They want to take a share from her estate as Asabah (agnates), although Asabah is itself unknown in the Shia school of thought. Can they (the Raafidhis) be her heirs in this case? Please explain and be rewarded. [1]

    THE ANSWER
All praise is to Almighty Allah Who guided us and safeguarded & protected us from Rifdh (rejection of faith – i.e. from being a Raafidhi Shia) and from Khurooj (exiting Islam – i.e. from being a Khariji) and released us from all sorts of calamities. Allah’s blessings and salutations be upon our master, our refuge and protection Hazrat Mohammed ; and blessings and salutations be upon his family and Companions who are the first and foremost in belief, and best in righteousness and staunch in faith and conviction. Ameen.

RAAFIDHIS ARE INELIGIBLE TO GET ANY INHERITANCE.

In the above mentioned query, the Raafidhi cousins are ineligible to get any share from the late Sayyed Sunni lady’s estate. In fact they do not have any right at all - even if they were her real brothers, let alone they being her maternal cousins. Furthermore, even if they were of a relation closer than brotherhood and even if they were not the deniers of Usoobat (being a agnate), (they do not have any right) - because their deprivation is due to the difference of their religion.
