if they killed Imam Husayn raDiyAllahu a'nhu because he was the grandson of the Prophet alaihi afDalus salatu wat-tasleem then they are kafir, otherwise, they are transgressors, and like yazeed. there is a fatwa from Hazrat Allamah Sharif ul Haq amjdi in his fatwa, look up there.
