    1. Are there any amongst the ahlebait and Sahaba radiAllahu anhum who are masum?
    2. Is khata e ijtihadi possible for Sayadah Fatimah Zahra and panj-tan Paak radiAllahu anhum?
    3. Is khata e ijtihadi possible for any of the Prophets of Allah peace be upon them all? If so would you list (some of) the ulama who were of this opinion?
    4. When discussing sayadah Fatimah Zahra radiAllahu Anha and masla e fadak Is it reasonable for a Sunni alim to restrict his opponents to only quote someone from the first three generations when asking for dalail on their stance? Isn’t this something the salafis do? Or is it the norm in Sunni circles?
    5. If possible could you translate and explain the passage from Pir Mehr Ali shah sahibs book alaihi rahmah, the one that doctor Jalali sahib were reading from when they made the comments?

    I think that's an excellent idea, but might I suggest the following. Before getting into the issues which have been MADE contentious, a few simple questions should be addressed first in order to cover the topic entirely without leaving any stone unturned.

    1. What exactly is Fadak?

    2. How did the Prophet (alayhil' salātu wa'l salām) use the proceeds from Fadak?

    3. In terms of size, how big was Fadak?

    4. Where was Fadak located?

    4. After the passing of the Prophet (alayhil' salātu wa'l salām), what changed?

    By 'formal or informal' I presume you mean directly in person or through a representative... Am I correct?

    Was any request made at all? Mawlana Saeed Asad, Chaman Jaman etc belong to the "no request" camp.

    Was the request informal or formal?

    Was Sayyidah Fatima (radiAllahu anha) aware of hadith regarding miraas of prophets at the time of request?

    Did Sayyidah Fatima (radiAllahu anha) "sulk" after Sayyiduna abu Bakr's (radiAllahu anhu) verdict/clarification on fadak?
    Mufti Fazl Chishti hasn't touched upon the aftermath, even though he is emphatic in his statements that request was indeed made even if informally (whether or not she was aware of hadith regarding miraas of prophets).

    Was the narrator who reported about disagreement mistaken? That's Allama Tayyib Naqshbandi's contention who says that unhappiness (or not maintaining terms) is narrated only in 1 hadith and that could be the "waham" of raawi (narrator)

    Was the request made once or on repeated occasions?

    Was any ijtihad done in request?

    Most important Q, did request for fadak amount to khata-e-ijtihadi? Which classical scholars have explicitly termed it so?

    Did few ummahat ul-mumineen (radi Allahu anhunna) also make separate claim to fadak? Mufti Fazl Chishti contends that they were intially disposed towards making the request but were reminded about the hadith-e-miraas by Sayyida Aisha (radi Allahu anha); so their request/claim to inheritance was never made.

    Less importantly, what happened to fadak later? How did the claim or/and possession change during the 1st century?

    In this video, Allama Tayyib Naqshbandi discredits Imam Asqalani's narration in fath ul-bari. Check the video around 10:57 mark. Can you opine on this?

    When this topic of fadak comes up many people seem to state that Bibi Fatima (Radiyallahu Anha) was not aware of the hadith when she asked for fadak but when she came to know then she accepted it (this was what Dr Jalali Sahib mentioned as well). However in Sahih Bukhari we see the contrary where she never accepted the decision of Hazrat Abu Bakr Siddique (Radiyallahu Anhu). In fact many of the earlier ulema also acknowledged that there was a disagreement.

    If you can expound on this matter with what our earlier ulema have stated then that will be helpful for all of us.

    Great idea.

    May I also suggest to keep the questions related only to the educational, historical, narrational (riwayah or rijal), eteqadi, etc. aspects of the matter.

    All of us including myself have also found ourselves inevitably mixing it up with the issue of pir politics and groupie alliances. We can save our commentaries on the pir politics issues for the other threads.

    a brother wrote to me asking to clarify a few issues about fadak.

    i was thinking of a rebuttal of nabeel afzal's talk and irfan shah's 'interview' with tasleem sabri. mawlana shahid was analysing nabeel's clip, and mufti fazal chishti was refuting pakistani maulvis (on irfan shah's side) arguing in this matter. so i have kept quiet.

    but apparently there is confusion surrounding the issue. to help clear the air, i think a good approach is to compile a FAQ. but for this i need your help.

    Please post your questions in this thread or send me in PM if you don't wish to ask in public. Especially about the irfan shah fiasco. you can ask as many Qs but don't make them compound; break them into multiple Qs if you like.
