Who is included in this ijma3? Just the Urdu/Punjabi speaking Hanafis of the subcontinent? Hanafis worldwide? What about the ulama of the remaining 3 mazhabs? Please do explain how it is an issue of aqidah or a mansus, qaati3ud dalalah hukm and not furu3. If it is a mansus hukm like command to pray 5 times a day or the prohibition of zina, then denial of such a commandment/prohibition makes one an outright kafir not just a mubtadi3i. Do we make takfir or tabdi3 of the Shafi3is, Malikis, and Hanabila for denying the wujub (as we interpret it) of the witr or qurbani or Eid namaz? Zia Ul Mustafa saab runs a madrasa for girls and there are videos of him being seated amongst women who wear the typical shalwar kameez sans Shara3i purdah. this is one example. Where does that all fit in according to the ijma3 of the ummah and Fatawa Ridawiyyah?
Well according to Mufti Akhtar Rida Alayhir Rahma. This is not Furū' (photos and videos) as well As Allama Zia Ul Mustafa. It been made furu to ease lives of those who do it. However one can argue to say there is Ijma on this matter by great Ulama of their time. To name a few Giants of their time : 1) Huzoor Mufti e Aazam 2) Huzoor Hafiz e Millat 3) Huzoor Ahsanul Ulama (father of sayed amin mia) 4) Mufti Waqaaruddin (waqarul fatawa) 5) Mufti Mujeeb Ashraf 6) Mufti Mujeeb ali And many other giants believed it to be haraam. The above mentioned scholars are no ordinary scholars. They the best of their time. So ijma' is still that its haraam. And i believe that these awliyah especially the likes of Mufti e Aazam and Ahsanul ulama would never make a mistake on such an important issue. To be honest, i see more harm being done with this than good. Allah knows best. But we should follow senior Ulama and not use our limited knowledge to classify these things.
