    Can you also shed light on what has happened to the funds that were collected for the girls college in Lancashire which has subsequently been sold for a neat profit? Hope the monies have not been spent abroad or on other projects? What is the ruling of this under the law of Waqf?

    i think some sunnis really need to lose the shakhsiyat parasti. why should we put our pirs above the shari'ah? should we not fear that we will be asked about this by Allah ta'ala on qiyamah?

    we must remember, we are sunnis, not deobandis. hence, we must look at the issue, not the people connected. no one is above shari'ah. we did not have this mentality that 'if my pir does it, then i just won't question it - it must be right'. it is new and it should go now.

    we got to be big enough that when a mistake is proven, we should accept and hold our hands up and admit: 'my pir made a mistake and i do not support him in that.' if not, we will all become like those wretched minhajis whose leader commits kufr openly, in front of millions, and they still support him.

    we must fear Allah ta'ala. our allegiance is to the shari'ah because that is infallible. so if a pir/molwi does not retract, the right thing to do is break the bay'ah and stop following him.

    His Eminence Allama Rasul Baksh Saeedi and His Eminence Hazrat Allama
    Bostan Qadri should be contacted as the Amir of Jammat Ahle Sunnat and Head
    of the Confederation of Sunni Masajid Midlands to check which of the
    Masajid the Trust runs have non Muslim Trustees.



    There needs to be full transparency and the congregation at Alum Rock needs
    to be informed.



    There are also various institutes funded by British Muslims that run in
    Pakistan under the Trust therefore it needs to be established who the
    Trustees of these institutes are.

    Are these institutes that Pir Niaz and Pir Fiaz are trustees of linked in any way or separate entities. As it seems some of the trustees are employed by other charities that both the Pirs are trustees of.

    Shadhilli you are an expert in Charity Law can you kindly comment if there are any infringements

    My original post was a QUERY with these symbols ??!! clearly in the heading seeking to clarify a viewpoint held by some. Which Abu Hasan has done detailing that the keys given to a non-Muslim cannot be inferred from this incident - as some have - as it is a weaker position of the two.

    This is further corroborated by Mufti Ahmad Yaar Khan Naeemi in his haashiya of Qur'an on 4:58 stating the stronger position that was mentioned by his teacher Sadrul Faazil Maulana Naeemuddin Muraadabaadi that the correct position was Sayyiduna Uthman bin Talha embraced Islam in 8AH before the conquest not after. A position that is mentioned by Shaykh Samir in his Seera tun Nabi Q & A's.

    Yes this is a disturbing revelation that will be taken-up with the appropriate people to get some clarification in light of Waqf and Charity law - looking at its wider implications ie registering Mosques as part of the charitable sector too as then these fall into a statutory regulted subsector and controlled by the law of England & Wales other the Islamic waqf framework enforced by the judiciary.

    Currently my library is in the loft as I am having some building works done so cannot access my key Refernce books

    I feel we have brought this to a single point that the - key given to a non-Muslim argument at the time - is a weaker position therefore cannot be advocated or inferred from as evidence to the contrary.

    I will not be posting on this matter any further - unless to update you guys on any change.

    generalisations like: 'entrusting a trust' without bothering to inquire whether a ruling exists in a specific case of 'awqaf' or 'ahkam e masjid' screams of ignorance.

    why then do you not take a hadith from a non-muslim if he is that 'trustworthy'?

    are you suggesting that we begin taking authorizations from non-muslim professors of hadith? [of course, fasiq muslims would be rather preferable]. because it is a trust and therefore in the parlance of hadith scholars we have: 'thiqah' or trustworthy.

    or how about khilafah? it is also a trust isn't it? [insert cut-n-pastes here] so that tahiris can consider the queen as a khalifah (please note that the taa marbutah is an indicator of ta'anith - feminine gender and therefore khalifah should actually be a woman according to the minhaji canon of generalisation - facts be damned and why allow a well-known exception to get in the way?).

    traditionally, shaykhu'l islam has owed his allegiance to the sovereign. therefore, since the queen is a khalifah, it is natural for the person touted as 'sheikul islam' and that is none other than tahir jhangvi. and as we have read in the principles of usul, local customs have a basis for acceptance in shariah [insert cut-n-pastes here and remember ibn abidin's work on `urf?] the local practice for honouring loyal servants of the crown is to knight them.

    uthman ibn TalHah became a muslim and migrated to madinah along with khalid ibn walid and `amr ibn al-`aaS raDiyallahu anhum during the truce of Hudaybiyyah. he was in the army of muslims on the Day of Victory.

    ibn Hajar says that in tafsir tha'alabi, it is reported without sanad that he became a muslim after RasulAllah sallAllahu alayhi wa sallam gave him the keys, but it is a munkar report as it is an well-known that sayyiduna uthman had become a muslim prior to the Victory.
