India of today is far more toxic than most countries in the West (barring the obvious Islamophobic countries like France, Hungary etc.). In the West, one may need to put up with Islamophobia and LGBTQ+ background noise, but there are enough practising christians and jews there to allow Muslims to enjoy similar level of freedom in their slip-stream. Mind you, the west hasn't really made any law/policy/practice to especially suit Muslims; but halal/zabiha food, sharia family courts, public prayer rooms, head scarves etc. are able to function only because jews etc. have managed to secure similar rights for themselves. Muslims in India are now worse off than 3rd class citizens (OBC, dalits etc. make up the 2nd/3rd tier). All state machineries are ranged against them, and public/govt don't even need to be pretend to be unbiased or politically correct anymore. A Muslim seeking life in the West to escape India is in a predicament of being caught between scylla and charybdis (aage kuan, pichhe khai!)
Shah Turabul Haq sahib too (rahimahullah) said that pakistanis if they really need to for pressing economic reasons, can go to Europe, usa etc for a few years to make some money, and then come back and settle in Pakistan. For us indians, Tajush Shari3ah (rahimahullah) passed away before i believe India was as modi-fied as it is now, and his India too was nowhere close to Ala Hazrat's India. Personally, I've always felt the west to be a lesser evil than modern independent india, from the Babri Masjid times onwards, so I convince myself that we have rukhsah but pakistanis don't! So I prefer to tell them do as I say, not as i do
we need to know the fiqh of these ahadith. are these mutlaq? what about when the arabs landed on the coasts of India? these were merchants too - and many of them settled here - and spread Islam. true, there were groups among them who were fleeing the persecution of hajjaj bin yusuf. but were all of them seeking asylum? if jalali sahib had expanded from books of fiqh too qe would have had greater clarity. something for ulama to explain. --- I have heard that huzur taaj al-shari'ah (رحمه الله) discouraged people from settling in Europe - but I have not heard that he ruled it mutlaqan haram. Allah knows best.
Dr Ashraf Jalali making the similar point as Mufti Fazl Chishti regarding the hypocrisy of people residing in the West & Europe. Unlike Fazl Chishti who condemned all Europe-based ulemas (in his meeting with Mufti Aslam Bandyalwi), Dr Jalali says it is permissible for muballighs to reside in the West, but not so for the common Muslims.
Mufti Fazl did a great job in countering the claims of the Tahreek e ruju in the issue of khata, especially when Jalali Sahib were locked up. However, the Mufti Sahib from the Saeedi Media highligted the harsh nature of Mufti Fazl and how he is a divisive figure. This now has been made clear on their issue with attending Allamah Khadim Hussain Rizvi's funeral and their meeting with Mufti Aslam Bandyalwi. I think he is best left to it.
Another video of Mufti Fazl Chishti (I know he is controversial) answering objections as to why he did not attend Khadim Hussain sahib's janazah. It's a long video and needs to be listened to fully but he has raised quite a few valid points in this with clips of Khadim Hussain Sahib which does raise a few questions. For example Khadim Hussain sahib's response when asked about working together with ppl like Tareeq Jameel et al.
