The question is general not specific. Thank you for letting me know your status and mode of traveling. The forum says" Ask and Answer a question" ( under hanafi fiqh). Do not underestimate the academic caliber of forum members. Just do some search and you will get to know that complex issues of aqida have been discussed on this forum. You may consider asking this as ' silly' and I respect your opinion. Now as per forum rule, let those who can answer.
Silly answers? What are you on about? I just made a factual statement about my mode of transportation. I wasn't negating the need for issuing fataawa for scenarios that one himself (the mufti) doesn't face or encounter. Anyway I still stand by my initial statement/question, why don't you approach or contact the muftis/ulama in question? Asking the 'knowledgeable' ones of the forum seems pretty silly to me. Cut out the middle man and approach the source.
The Murideen are active on this forum and in past they have replied to many queries related with question related to their shuyookh. Many a times, the murideen have given web links containing clarification/ reply related to many questions pertaining to their shuyookh. Secondly, the question was not reserved for murideen only. It was mentioned clearly "or any one who is knowledgeable". Since the forum rule says " Ask and Answer a question", hence there is no qabahat in asking the question here. Regarding your travel, then please note that every one does not have the liberty of traveling on four wheeler every time. More ever, general condition takes precedence over specific and uncommon conditions. Why do Muftis in subcontinent need to explain how to perform salah in space or polar region, when they do no travel is space? Please don't give silly answers.
Why do you want the mureedeen to prove the validity of the fatwa. Why don't you approch the ulama who signed and attested the fatwa in question. I don't travel on trains. I Prefer the 4-wheel alternative.
Mufti Nazir Ashraf Nagpuri gave a fatwa ( chalti rail per namazon ka hukm, page 30) that those "molvi sahibaan" who consider that in today's time the fard and wajib salah performed on a moving train in India ,need not be performed later, have committed a " na jaayaz, dalaalat and haram" act. According to him the opposite view ( that salah must be repeated later) is a " majmua alaih " ruling of ahlus sunnah. As per Mufti Nazir Ashraf Nagpuri those" molvi sahibaan" who hold the view that salah need not be repeated are not aware of the ahkam of shariah. These "molvis" should do tawba and must change their opinion . Since these "molvis" have purposely gone against an agreed upon decision, they are no longer fit to lead congregational salah. This fatwa has been approved by Mufti Akhtar Raza Khan and Mawlana Zia al Mustafa. I request all murideen of Mufti Akhtar Raza Khan and Mawlana Zia al Mustafa , or any one who is knowledgeable to prove that how in the light of methodology of Ala Hazrat, the "molvis" are not fit to lead congregational salah. Notes: 1) Original fatwa has been attached. For all discussion purpose, the original Urdu fatwa text will be considered, since some people may consider that my translation is not accurate. I do not want to give wrong message to the readers. Hence Urdu fatwa text will be considered for discussion. 2)This thread is not about whether salah performed on a moving train must be repeated or not. Those interested can start this topic in another thread. 3) The thread is about how those who hold the opposite view are unfit to lead salah. ( Please note this carefully) 4) Now please do not raise questions like: a) Define Ijma b) What is your view about those who go against Ijma? c) Is salah behind those scholars who go against Ijma valid? d) Are the children born to those scholars who go against Ijam,legitimate? e) What is your view on this matter? etc etc etc. 4) I have put forward a simple and straight question. Any one who agrees with this Nagpuri Train fatwa ( attested and approved by Mufti Akhtar Raza Khan and Mawlana Zia al Mustafa) is requested to bring forward the evidence that how the sunni scholars who hold a different opinion in this matter, are unfit to lead salah. 5) For records: I do not agree to this fatwa . However, if any one proves that as per methodology of Ala Hazrat, these scholars are unfit to lead salah, I will change my view on this matter and will announce that openly on this forum. 6) The matter is very simple. Please do not make it complex. Those who agree with this fatwa need to prove what is being asked . That is all. Do not feel cornered and start asking reverse question. I have said, I will change my view if the fatwa is proved to be correct in the light of "maslak e ala hazrat". 7) Please do not bring emotional and spiritual attachment with any particular shaykh in this thread. This is purely an issue of jurisprudence. Hence , those who agree with this fatwa, it is their responsibility to bring evidence to prove the authenticity of the fatwa in the light of methodology of Ala Hazrat.
