Their response: آپ فقط اس شخص کو توبہ کی ترغیب دلا سکتے ہیں اور یوں کہہ سکتے ہیں کہ میں نے معلوم کیا ہے کہ یہ جملہ کفریہ ہے ۔
Surely this is an inadequate response. What if zayd claims things which can have no second interpretation, such as claiming in clear words that the Quran has been changed? Then does Amr need to seek a mufti's opinion before doing takfeer? And then, when the mufti says 'zayd is a kaafir and the one who doubts is also a kaafir', then doesn't that mean Amr is a kaafir as he sought a fatwa whilst suspending judgement? Was no one allowed to do takfeer of mirza ghulam until a mufti did so first despite being the takfeer being done on the basis of the same words in the same books read by zayd and amr? This is an inadequate fatwa lacking comprehensiveness as not all statements of kufr are the same (in their possibility of being interpreted with both kufr and non kufr meanings)
Salam e Masnoon. It has been brought to my notice that Mufti Nizamuddin Misbahi sahib has recently claimed that only a mujtahid can do takfir. No one else has the right. I do not know the source of this 'rumour' if at all it's just a rumour. If members here have contacts who can verify or negate this news please post here. People who might be inclined to think that i am prejudiced against mufti sahib should check the archives and see how much praise and respect I have had for him and even after his recent fatwa exonerating ubaidullah azmi I am still assuming the best of him, that it was not intentional, that he was either forced or misinformed. You can even ask Abdal Qadir and sidi abu Hasan if I have not presented him as a hujjah during discussions in private mail. But, if the above news is correct then it's something to take note of. wassalaam.
