Question 1084 – 14th Shawwal, 1321 AH

What do the scholars say about the issue that during Ramadan, is it permissible to miss the congregation of Witr and to leave the Masjid? Can such a person be called a Fasiq and Fajir? What is the ruling of the Shari’ah?

Answer: The congregation of Witr is neither Wahib nor Sunnah Mu’akkada. There is no sin for missing it. Moreover, there is disagreement on whether its congregation is better or praying it alone. It is in Durr al-Mukhtar that is it better to pray the Witr in congregation or at home alone? Both actions have been approved.

Question 1085 – 23rd Muharram, 1339 AH

What do the scholars say about reciting Sura Ikhlas after Sura Fatiha in Witr salah? Is it a must or can one recite another Sura?

Answer: There is no restriction. One can recite any Sura – either short verses or one long verse.

Question 1086 – 9th Safar, 1339 AH

What should be read if one forgets the Du’a al-Qunut in Witr? Will one have to perform Sajdah al-Sahw in this case?

Answer: Reading any du’a wil fulfil the Wajib of Qunut. Yes, if someone did not recite any du’a whatsoever due to forgetfulness, then he should do Sajdah al-Sahw.

Question 1087 – 9th Ramadan, 1337 AH

What do the scholars say about the Masbuq [latecomer] for Witr? Should he recite the Qunut or not?

Answer: If the Masbuq missed all three rak’ahs; then he should recite the Qunut at the end and if he even got only one rak’ah – even if he joined the Imam in ruku’ of the third – then he should not recite the Qunut in the remaining prayer. It is in Durr al-Mukhtar that:

The Masbuq should recite only the Qunut with the Imam. If he joined during the ruku’ of the third rak’ah; then he will become a Mudrik [One who joins the congregation without missing any rak’ahs].

Assalaam Alaikum

I have heard/read that Ala Hadrat's(RadhiAllah Anho) written in regards to the
sitting postures some sunnis adopt during jumaah khutba i.e. folded on naval during first part and placed on the laps during second part of khutba.

I realise its not obligatory nor stressed by shariah,but would still like to know more as to where this is stated.

Can someone dig this up please?

perhaps it may be to do with some fuqaha saying that the khuTba is instead of the two rak'ahs of dhuhr that we miss. i.e. 4 farD for dhuhr but only 2 for jumu'ah.

hence, people sit as they would for a two rak'ah prayer if they were seated. if i remember, it was shams al-a'imma sarkhasi [author of al-mabsut] who is amongst those fuqaha who say the khuTba replaces the two units.

Yes sidi, i am aware of the above reasoning but also quite sure i've read that Ala Hadrat(RA) also mentions it in one of his writings.

It would be good to read the explanation and set the mind to rest.
 
in fatawa hamidiya, hujjat al-islam mawlana hamid raza khan barelwi raHimahullah writes that one who missed the jama'ah of isha' should pray the witr alone and not with the congregation.
